Rex Business Flyer is a simple and unique program to assist businesses save on their travel costs. The program offers two (2) Reward Flights (exclusive of taxes and charges) for every eighteen eligible flight sectors flown. Reward Flights are redeemable on any sector on the Rex network. 1. Introduction (a) These Terms and Conditions, as amended from time to time, apply to all aspects of the Rex Business Flyer Programme. (b) Rex has used all reasonable efforts to ensure the information provided to Members in relation to the Programme is accurate and correct. However, to the extent permitted by law, Rex accepts no responsibility for any inaccuracy or misdescription. (c) By agreeing to purchase Rex Business Flyer Membership and using the Membership number, the Member agrees to be bound by these Terms and Conditions and the Conditions of Carriage of Rex.
2. Definitions In these Terms and Conditions, unless the context otherwise requires: Administration Fee means the prevailing administrative fee as stipulated on Rex’s website; Administrator means the person nominated by the Member to administer all aspects of the Membership account including the redemption of Reward Flights. Eligible Sector means a Sector flown by a Member using a ticket that is not a Community Fare, Promo Fare, a Free ticket or a Discounted Ticket;
Free or Discounted Ticket, includes but is not limited to: (a) tickets issued as Promo fares; (b) tickets or sectors flown on chartered / non RPT flights; (c) tickets issued as Rex Business Flyer Rewards Flights; (d) travel industry rebated tickets; (e) tickets acquired under a sponsorship arrangement (e.g. competition prize or auction); or (f) tickets issued as a gesture of goodwill. Member means the company which has a current membership to the Programme. Partner Service Provider means those suppliers with which Rex has an agreement for the supply of goods or services to Members; Programme refers to the Rex Business Flyer Programme. Rex means Regional Express Pty Limited (ACN 101 325 642) and Rex Airlines Pty Ltd (ACN 642 400 048) Rex Business Flyer means Rex’s frequent flyer programme for businesses which is governed by these Terms and Conditions; Rex Business Flyer Account means a membership of the Rex Business Flyer opened and operated by Regional Express upon processing a Member’s application; Rex Business Flyer Rewards Point means each point that accrues to the Member's Account as a result of the Member booking and flying an Eligible Sector with Rex. A Member will be awarded one Rex Business Flyer Reward Point for each Eligible Sector flown by the Member in accordance with the Terms and Conditions set out in Clause 5; Sector is defined by the number of boarding passes issued to the Member by Rex for any particular flight. One boarding pass is equal to one sector. For example a flight from Sydney to Melbourne via Albury requires two boarding passes and therefore counts as two sectors or flights. A flight from Mildura to Sydney via Griffith is one boarding pass and therefore counts as one sector or flight. Return flights are counted as two sectors.
3. Membership 3.1 General (a) Membership is only open to businesses/organisations with a valid ABN. (b) Rex reserves the right to deny any membership application. (c) Each Member will be assigned a Membership number. There is only one Membership number per business/organisation. (d) Membership is not transferable between businesses/organisations and is not refundable. 3.2 General (a) Rex reserves the right to vary these Terms and Conditions in its sole discretion at any time and without notice. (b) Rex will use reasonable endeavours to advise Members of any changes to the Terms and Conditions, including emailing the Members at the address provided but does not accept any liability whatsoever for any failure to do so. (c) Rex may in the future change the Rex Business Flyer sector based programme to a points or mileage programme. (d) Subject to the above, the Rex Business Flyer Membership costs $99.00 (inclusive of GST) and is valid for 2 years. Renewal of Membership is subject to acceptance.
4. How to Earn Rex Business Flyer Rewards Points 4.1 General (a) Rex Business Flyer Rewards Points can only be earned after the Rex Business Flyer membership number has been issued to the Member. (b) To earn Rex Business Flyer Rewards Points, Members must quote their name and Membership number as per the Rex Business Flyer account records when booking an Eligible Sector flight. Flights that are not booked on Rex's website, Rex's call centre or travel agents are not guaranteed of being awarded Reward Points as the systems may not be compatible. (c) It is the Member’s responsibility to ensure that the correct details are provided and this should be confirmed at the time of check-in of the flight. Members who have forgotten to include the Membership Number can still do so at time of check-in. (d) There will be no retrospective award of Reward Points after check-in is completed and Rex will not entertain any such requests under any circumstances including circumstances covered in (b) above. (e) Any discrepancies in respect of Rex Business Flyer Rewards Points must be brought to the attention of the Rex Service Centre at Online Help by the Member within three (3) months of the applicable flight or transaction. No amendments will be made after this period. (f) Rex Business Flyer Rewards Points cannot be sold, assigned, transferred or otherwise redeemed (whether for valuable consideration or otherwise) except in accordance with these Terms and Conditions. (g) Only an employee or owner of the Member is allowed to accrue Reward Points under the Programme. (h) Rex Business Flyer Rewards Points will not be awarded (and may be deducted from Members’ Rex Flyer Accounts) for cancellations/refunds made by or on behalf of the Member. 4.2 Award of Rex Business Flyer Reward Flights Upon a Member accruing eighteen (18) Rex Business Flyer Rewards Points, Rex will award the Member with two Rex Business Flyer Reward Flights and deduct the 18 Reward Points accordingly. Rex Business Flyer reward flights will generally accrue and be issued within 72hrs of completion of an Eligible Sector flown by a Member. 4.3 Rex Business Flyer Rewards Points Validity Rex Business Flyer Rewards Points that are accrued and not converted to Reward Flights will expire two (2) years from the date on which the relevant Rex Business Flyer Rewards Point was earned. Points that have expired cannot be reinstated under any circumstances. All Rex Business Flyer Reward points that are accrued and not converted to Reward Flights will be forfeited upon Membership expiry.
5. Redemption of Reward Flights (a) The Rex Business Flyer Reward Flight / Redemption has last seat availability. The fare conditions associated with the Reward / Redemption flight can be found at: http://www.rex.com.au/specials/fare_rules.aspx (b) The redemption of a seat using the Reward Flight entitlement entails the payment of airport and other taxes charged by external parties which are subject to change. (c) The Member can use the Reward Flight to redeem for flights under any person's name including non-employees. However, it should be noted that Rex has a list of names of people who are banned from flying on the airline. Should the redemption be in the name of someone on our list, Rex reserves the right to reject the redemption and the Member needs to redeem under a different name. (d) Use of Rex Business Flyer Reward Flight tickets that have been acquired by purchase or obtained for any other consideration, may result in the tickets being confiscated, the passenger being denied boarding or both. (e) Rex Business Flyer Reward Flights must be booked and flown within six months from the date of award of the Reward Flight. Once expired, Rex Business Flyer Reward Flights cannot be reinstated. A statement of the Member’s account is sent by email every month and the status can also be viewed by the Administrator accessing the Member’s My Account page online. (f) Redemption of Reward Flight(s) can be made by the Administrator either:
6. Changes & Re-issues after redemption of flight (a) Once a redemption flight is booked, any subsequent changes will be subject to the same fees that govern a normal ticket. The fare conditions associated with the Reward/Redemption flight, including changes and re-issues can be found at: http://www.rex.com.au/specials/fare_rules.aspx (b) Failure to board (i.e. no-show) will result in the forfeiture of that issued Reward Flight ticket.
7. Breach of Terms and Conditions Rex reserves the right to: (a) cancel or refuse to honour any Rex Business Flyer Reward Flight which was booked, sold, assigned, transferred or otherwise obtained or redeemed in breach of these Terms and Conditions at any time, without liability; (b) reverse or cancel any flights credited to a Member incorrectly, not in accordance with or in breach of these Terms and Conditions at any time without liability. (c) suspend a Member's Membership, and reverse or cancel any accrued Rex Business Flyer Rewards Points from a Member's Rex Business Flyer Account in the event that monies are owed by that Member to Rex or any of its subsidiaries and such monies remain unpaid after the due date.
8. Membership Term Membership to the Programme is valid for two years. Membership can be renewed upon the payment of prevailing membership fees. Once membership expires, all accrued Reward Points will be forfeited; Reward Flights will continue to be valid for redemption and use within 6 months of award.
9. Taxable Benefit If the Member is an Australian taxpayer, free flights earned under the Rex Business Flyer programme may be subject to personal income or other tax assessment. Accordingly, Members are advised to check with their accountant, lawyer or tax adviser for further advice.
10. Use of Personal Information 10.1 It is a condition of Membership that the Member consents to the Privacy Policy as published on Rex's website and authorises Rex to use and disclose to Partner Service Providers. (a) The Member must advise Rex of any change of contact details. Changes must be made by the Administrator accessing the Member’s My Account page online. (b) Rex is responsible for sending monthly updates and may send notices from time to time to the Member at the email address provided. Any notice by Rex under these Terms of Use by email shall be deemed given on the day the email is sent. 10.2 Rex will provide the Administrator with access to the Member's personal information held by Rex on request by the Member to the extent permitted or required by law.
11. Termination 11.1 Rex reserves the right at any time in its absolute discretion and without notice to: (a) terminate or materially alter any Rex Business Flyer services, or any aspect of the operation of the Programme; (b) revoke the Membership of the Member to the Programme or the right of the Member to use the Membership Card or both. 11.2 Any breach of these Terms and Conditions whether intentional or otherwise may result in termination of Membership or the cancellation of Rex Business Flyer Rewards Points or Reward Flights or both at the sole discretion of Rex. 11.3 Without limiting Rex's ability to terminate a Member's Membership under any other provision of these Terms and Conditions, Rex may terminate a Membership if, in the reasonable opinion of Rex, the Member has: (a) abused any facilities, products, services or arrangements afforded to the Member as a result of Membership in Rex Business Flyer or otherwise as a passenger of Rex; (b) the Member has displayed or engaged in inappropriate behaviour whilst on-board a Rex flight or in premises controlled by Rex, which is or may be likely to be detrimental to the interests of Rex; (c) supplied or attempted to supply misleading information, or make any misrepresentation to Rex. 11.4 Membership will automatically terminate in the event of the business/organisation ceasing to trade. 11.5 Unless otherwise set out in these Terms and Conditions, upon the termination of a Membership, Rex will not refund the Membership Fee.
12. Governing Laws These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales irrespective of where the application for Membership has been completed by the Member or submitted to Rex. Any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions against Rex shall unless otherwise agreed by Rex be instituted and carried on only in the appropriate Court of the State of New South Wales. Nothing in these Terms and Conditions will prevent the application of your consumer guarantees in accordance with the Australian Consumer Law.
