Introduction

These Terms and Conditions, as amended from time to time, apply to all aspects of the Rex Bid Upgrade program.

Any future amendments to these Terms and Conditions will apply to the use of all Rex Bid Upgrades and Upgrade Requests.

Rex has used all reasonable efforts to ensure the information in these Terms and Conditions is accurate and correct. However, to the extent permitted by law, Rex accepts no responsibility for any inaccuracy or misdescription.

By agreeing to receive and use a Rex Bid Upgrade you agree to these Terms and Conditions, the Conditions of Carriage, and Privacy Policy of Rex.

 

Definitions

Rex Bid Upgrade (Bid Upgrade, Upgrade) refers to this program that provides the ability for a customer to submit an offer for an upgrade from the Economy to Business Class cabin.

Rex Airlines (Rex) means Regional Express Holdings Limited ABN 18 099 547 270.

Customer means any individual who has purchased a fare to travel with Rex.

Eligible Customer (You) is the individual that has been invited to request a Bid Upgrade.

Invitation means an invitation that Rex extends to an Eligible Customer to make an Offer.

Offer (Bid) means the amount of money that an Eligible Customer has offered to upgrade all Customers in their original booking from their original class of travel to a higher class of travel as the Invitation.

Original Booking is the fare purchased and flight sector(s) of the booking made by a Customer that has been extended an invitation for a Bid Upgrade.

Upgraded Booking is the flight sector(s) of the booking that has been successfully upgraded from the Economy to Business Class cabin as a result of an invitation being accepted by Rex.

 

Invitations to Bid Upgrade

Not all bookings are eligible for Bid Upgrades. Rex has the right to determine eligibility at its sole discretion.

A Bid Upgrade is for a single flight sector and does not apply across connecting flight sectors. Separate Bid Upgrades Offers must be submitted for each flight sector eligible for a Bid Upgrade Offer.

Bid Upgrades are subject to availability and not all seats may be made available for Upgrades. There may be empty seats left in the cabin from time to time for operational reasons.

You may check your eligibility at the Rex Bid Upgrade website page, alternatively we may send an invitation to make an offer for a Bid Upgrade. To receive an invitation an Eligible Customer must ensure their correct email is included in their booking.

 

Making an upgrade offer

You must be at least 18 years of age to submit an Offer.

An Offer can only be made on behalf of all Customers in the Original Booking. By making an Offer, you are confirming you have authority to submit an Offer on behalf of all Customers in the Original Booking.

You may make or change an unconfirmed Offer from the time that you are eligible to request an Offer until 3 hours prior to the scheduled flight departure, or until Rex confirms and accepts the Offer.

Minimum and maximum offer ranges, and amounts, are set for each flight. These amounts may change from time to time at the discretion of Rex. All Offers must be in whole dollars.

 

Acceptance of an upgrade offer

Rex reserves the right to determine if an Offer will be accepted and makes no representation that any Customer will receive an Upgrade.

Payment for an Upgrade will be processed when an Offer is accepted by Rex. In the event that payment is unable to be processed, Rex reserves the right to cancel the Upgrade.

Upgraded Customers will not receive additional complimentary checked baggage allowance. The original ticketed Economy Class checked baggage allowance will apply.

Rex Lounge access is not included for Upgraded Bookings. Rex Lounge access may be purchased separately for eligible Economy Class Fares.

Rex will attempt to deliver the onboard benefits usually associated with Rex Business Class service, but does not guarantee that any Customer on an Upgraded Booking will receive all the benefits and inclusions of Business Class. Separate Terms and Conditions may also apply to the benefits and inclusions of Business Class.

Any special requests, including meals and seating requests, included in the Original Booking are not guaranteed for the Upgraded Booking.

Any pre-purchased seat selection will be forfeited when an Offer is accepted.

Upgraded bookings may not have similar seating arrangements to the Original Booking.

Seat selection may only be available at check-in, and Rex cannot guarantee a Customer’s preferred seating and Customers may not be seated together.

The Fare Rules and Conditions of Carriage the Original Booking continue to apply to the Upgraded booking.

 

Cancellations and Refunds

You may cancel an unconfirmed upgrade request at any time before Rex accepts the Offer for a Bid Upgrade of the Original Booking.

Once an Offer has been accepted, the Bid Upgrade is non-refundable, non-transferable and non-changeable (e.g.: no date, flight or destination changes).

A Bid Upgrade may only be refundable if:

  • the flight sector is cancelled by Rex and Rex is unable to re-accommodate Customers in the Upgraded Booking to an alternative flight in the Business Class cabin;
  • a delayed flight results in a Customer missing a connection and Rex is unable to accommodate customers in the Upgraded Booking to an alternative flight in the Business Class cabin;
  • Rex is unable to accommodate Customers of an Upgraded Booking due to operational, safety or security reasons that make the Business cabin seats unavailable; or
  • a Customer is entitled to a refund of a Bid Upgrade under the Australian Consumer Law.

You must retain all relevant documentation (including boarding passes, e-tickets) to submit a refund request.

A Bid Upgrade refund request must be made by contacting the Rex Customer Contact Centre on 13 17 13 or via our feedback form here. All requests must be made within 3 months of departure of the flight sector within the Upgraded Booking.

 

Governing Laws

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales.

Nothing in these Terms and Conditions will prevent the application of your consumer guarantees in accordance with the Australian Consumer Law.
